    WE, THE UNDERSIGNED ARBITRATORS, having been designated in accordance with the arbitration agreement entered into between the above-named parties and dated May 16, 2013, and having been duly sworn, and having duly heard the proofs and allegations of the parties, and pursuant to the American Arbitration Association ("AAA") Construction Arbitration Rules dated October 1, 2009, do hereby issue this FINAL AWARD, as follows:

    On November 18, 2015, the International Centre for Dispute Resolution ("ICDR"), the international division of the AAA, transmitted to the parties the Partial Final Award in this matter. The Partial Final Award was duly executed by the Panel and dated November 17, 2015, and is incorporated herein in its entirety by reference. Pursuant to the Partial Final Award, the determination of attorneys' fees both as to entitlement and quantum was deferred to allow the parties to make additional submissions. Each party has made additional submissions which have been carefully reviewed by the Panel. The Panel has previously determined that the Claimant is the "prevailing party" for the purposes of the recovery of reasonable attorney’s fees in accordance with Section 15.5.4 within ALA Document A201 of the parties’ Agreement. Based on our review of all relevant facts and circumstances, including the applicability of the relevant lodestar factors for the determination of the appropriate award of legal fees, we award the Claimant the following:

    Don Erwin: US$-0- **
    Vrem/3D Model: US$2,550.00
    Misc. Process: US$586.00
    ICDR Fees paid by G.O. Construction US$-0-***
    Total: US$388,891.00

    * The work performed by attorney Singh provided no "value-added" to the arbitration.

    ** The testimony/work product of Mr. Erwin was not of assistance to the Panel.

    *** The ICDR’s administrative fees and the compensation of the Tribunal shall be borne as incurred.

    Accordingly, Respondent PCA Capital LLC shall pay to Claimant G.O. Construction Corp. the amount of US$388,891.00, representing the amount due to the Claimant as the "Prevailing Party’ in this Arbitration, within five days of the date of this Final Award after which interest shall accrue on amounts unpaid at the rate of 9% per annum.

    Therefore, for purposes of clarity, the total sum awarded to the Claimant during the pendency of this proceeding, inclusive of the Partial Final Award but exclusive of accrued interest on the sum awarded to the Claimant in the Partial Final Award, is US$891,345.55.

    The Panel strongly disapproves of the Respondent’s disclosure of confidential events that occurred during the parties’ mediation. However, such disclosure in no way impacted the Panel’s Final Award.

    For the reasons stated above, we award as follows:

    1. The Partial Final Award of November 17, 2015 is incorporated herein in its entirety by reference.

    2. Claimant G.O. Construction Corp. is awarded US$388,891.00 for attorneys’ fees and costs. Therefore, Respondent PCA Capital LLC shall pay to Claimant G.O. Construction Corp. the amount of US$388,891.00 within five days of the date of this Final Award, after which interest shall accrue on amounts unpaid at the rate of 9% per annum,

    3. The administrative fees and expenses of the ICDR, totaling US$20,150.00, and the compensation and expenses of the Tribunal, totaling US$203,206.87, shall be borne by the parties as incurred.

    4. This Final Award is in full settlement of all claims and counterclaims submitted to this Arbitration.

    5. This Final Award may be executed in any number of counterparts, each of which shall be deemed an original, and all of which shall constitute together one and the same instrument.

    We hereby certify that, for the purposes of Article I of the New York Convention of 1958, on the Recognition and Enforcement of Foreign Arbitral Awards, this Final Award was made in New York, New York, United States of America.
