    A pre-hearing conference was held before the undersigned Arbitrator on June 4, 2012. In attendance were Barry Leon and Owen Bourns for the Claimant, Mark Vasco and Peggy Kane for the Respondents, and Tom Simotas for the AAA. The purpose of the conference was to establish schedules for (i) the disposition of Claimant’s request, filed on June 4, 2012, for a partial award of attorneys’ fees incurred in connection with the presentation and disposition of the issues relating to the validity and enforceability of the Non-Competition Agreement and the Non-Solicitation Agreement; and (ii) the presentation and disposition of Respondents’ Partial Motion to Dismiss Claimant’s Amended Claim, which motion was filed on January 6, 2012.

    With the agreement of the parties, the following schedule was established:

    1. Respondent shall have until June 11, 2012 within which to respond to Claimant’s Request for Partial Award of Attorneys’ Fees;

    2. Claimant’s response to Respondents’ Partial Motion to Dismiss shall be due on or before June 25;

    3. Respondents’ reply to Claimant’s response to the Motion to Dismiss shall be due on or before July 16, 2012.
